ieffy.com User Contract Article 1 (Objectives) The following Website Terms of Use Agreement (the "Agreement") is to define ieffy.com's and user's rights, obligations and responsibilities in the internet-related services (the "Services") provided by ieffy.com. All ieffy.com services are provided to a person for personal use and as a capacity of person only. Article 2 (Definitions) (1) ieffy.com is a cyber business which can trade products and/or services using communication equipments for providing products and/or services to customers, and ieffy.com also means a business proprietor who operates the cyber mall. (2) A "user" is a member or a non-member who accesses the Site and uses the Services provided by ieffy.com. (3) A "member" is one who provides his personal information and registers at the Site, one who continuously receives information provided by ieffy.com, and one who can continuously use the Services provide by ieffy.com. (4) A "non-member" is one who does not register at the Site, but just use the Services provided by ieffy.com. Article 3 (Agreement Specification and Modification) (1) At the front page of ieffy.com Cyber Mall, ieffy.com will post for users the contents of Agreement, Firm's name, Firm's address, Representative's name, Business Registration Number, Contact points (telephone number, fax number, e-mail address, etc.). (2) ieffy.com can modify the Agreement to the extents without running counter to the Law such as the Agreement Regulation Law, the Law for Electronic Business Standards, the Law for Electronic Signature Standards, the Law relating Usage Promotion of Information Network, the Law relating Door-to-Door Sales, and the Consumer's Protection Law. (3) In the case the ieffy.com modify the Agreement, ieffy.com will specify its applied date and reasons for modification, and post it at the front homepage of ieffy.com from the 7 days before to the day before its applied date. (4) In the case the ieffy.com modify the Agreement, it will be applied to the contracts after its applied date, and to the contracts already concluded the Agreement before modification is applied. However, if users already contracted want to apply the modified Agreement and obtain an approval from ieffy.com during the period of notice of the modified Agreement in Clause 3, the modified Agreement can be applied. (5) Items not defined in the Agreement and the translation of the Agreement follow the Customer Protection Guiding Principles for Electronic Business established by the Government, the related Regulations, and the custom of trade. Article 4 (Provision and Change of Services) (1) ieffy.com executes the following business: 1. Provision of information about commodities or services and conclusion of purchase contracts (2) In the case of out of stock or technical specification changes, ieffy.com can modify the contents of commodities and services provided for the contracts which will be concluded in the future. In this case ieffy.com will clearly specify modified contents of commodities and services, and notice them at the same page of the current ones from 7 days before the date of new provision. (3) In the case that ieffy.com modify the contents of services after contract because of out of stock or technical specification changes, etc. such that users may suffer for damages, ieffy.com will compensate the damages; however, if ieffy.com has no intention or fault for such damages, ieffy.com will not. Article 5 (provision of services) (1) ieffy.com may suspend the provision of services in the case of repair, inspection, or breakdown of communication equipments, cessation of communication, etc. . (2) In the case of the suspension of services in Clause 1, ieffy.com will notify users by the means described in Article 8. (3) If users or the third person may suffer for damages by the temporary suspension of services because of the reasons in Clause 1, ieffy.com will compensate the damages; however, if ieffy.com has no intention or fault for such damages, ieffy.com will not. Article 6 (Membership Admission) (1) A user may apply the membership admission by filling up his/her personal information in the prescribed registration form by ieffy.com and indicating his/her intention to consent this Agreement. (2) ieffy.com will approve the membership admission if the applicant does not fall under the following Phrases. 1. In the case that the applicant had been disqualified from the membership by the Article 7 Clause 3; but, excepting the case the applicant achieve the readmission of membership from ieffy.com after 3 years he/she had been disqualified. 2. In the case that there be false statements, entry omission, or clerical errors in the contents of registration. 3. In the case that ieffy.com conclude that his membership admission cause technical inconvenience (3) The conclusion time for the contract of membership admission is the point of time the approval of ieffy.com arrives at the member. (4) In the case there are any changes in the contents of registration by the Article 15 Clause 1, the member should notify the changes to ieffy.com by e-mail or other way. Article 7 (Membership Withdrawal and Loss of Membership) (1) A member can withdraw his/her membership anytime, and ieffy.com immediately process the membership withdrawal. (2) In the case that a member fall under the following causes, ieffy.com may limit and suspend his/her membership. 1. In the case that the member write down false statements in the application form of admission. 2. In the case that the member does not discharge his/her payment for commodities or services of ieffy.com or liabilities the member has to bear for the use associated with ieffy.com. 3. In the case that the member interrupt the use of ieffy.com or misuse information provided by ieffy.com and so on such that he/she threat the electronic business order. 4. In the case that the member does act prohibited by this Agreement or run counter to the public order and customs using ieffy.com. 5. In the case that the member post bad language or abused statements or advertisement when he/she use the bulletin board and Q&A. (3) In the case that the member repeat the same thing more than or equal to twice after ieffy.com limit or suspend the membership or he/she does not correct his/her deed, ieffy.com may make his/her membership disqualified. (4) ieffy.com cancel the member's registration in the case ieffy.com make his/her membership disqualified. For the case ieffy.com notify it to the member and give him/her a chance to explain before the cancellation. . Article 8 (Notice to Members) (1) When ieffy.com inform to a member, ieffy.com may send a notice using an e-mail address the member submitted. (2) Instead ieffy.com send notices to a large number of members, ieffy.com may post them on the bulletin board for more than or equal to a week and it will be considered to have same effects. Article 9 (Application for Purchasing) (1) Users of ieffy.com may apply purchasing in the ieffy.com cyber mall by the following way 1. Input purchaser's name, address, and telephone number. 2. Select commodities or services. 3. Select the method of payment. 4. Designate your confirmation to this Agreement (for example, mouse click). Article 10 (Establishment of Contrat) (1) ieffy.com may approve the purchasing application in the Article 9 if it is not come under the following Phrases. 1. In the case that there be false statements, entry omission, or clerical errors in the contents of the application. 2. In the case that under-age purchase commodities or services prohibited by the Juvenile Protection Law such as cigarettes, liquors, etc. 3. In the case that ieffy.com conclude that the approval of purchasing application cause technical inconvenience of ieffy.com cyber mall. (2) The contract is established at the time the approval of ieffy.com is arrived at the User by the form of receipt-certified notice in the Article 12 Clause 1. Article 11 (Method of Payment) The method of payment for commodities or services purchased from ieffy.com can be one the followings. 1. Account Transfer 2. Credit Card Settlement 3. Online Payment without Bankbook 4. Settlement by Electronic Cash 5. Payment when receiving Commodities Article 12 (Receipt-certified Notice, Change and Cancellation of Purchasing Application) (1) ieffy.com sends the receipt-certified notice to the User who applies purchasing. (2) The user may request the change or cancellation of purchasing application immediately after he receives the receipt-certified notice in the case that there is any discordance. (3) ieffy.com may immediately process the request by the User in the case that there is the change or cancellation of purchasing application before delivery. Article 13 (Delivery) (1) The delivery time required is as follows counting from the date after purchasing order. - General Delivery (the date of purchasing order, holiday excepted): Seoul/Kyeonggi¡æ 2 to 5 days, Other Areas¡æ 3 to 8 days - Will not be delivered on a holiday or a day off. - In the case of the payment without bankbook, the delivery time required is counted from the date of checking the payment. - In the case that something beyond control happens such as a natural disaster, the corresponding dates are exempted from the delivery dates required. (2) In the case that commodities or services ordered cannot be supplied because of out of stock and so on, ieffy.com will take actions necessary for the refund and send a notice of reason to the User within 3 days from the date of the payment. Article 14 (Refunds, Return of Goods and Exchange) (1) In the case that ieffy.com cannot supply commodities or provide services because of out of stock and so on after order, ieffy.com immediately inform the reason to the User, and in the case that ieffy.com already received the payment within 3 days from the date of the payment or otherwise within 3 days from the date of the happening ieffy.com will take actions necessary for the cancellation of contract and refunds. (2) For the cases in the following, even if ieffy.com already finished delivery, ieffy.com will immediately take actions necessary for refunds, return of goods, and exchange within the next business day after receiving the returned goods. However, the dates that can be required are no more than 20 days from the date of delivery. 1. In the case that the delivered goods are different from the ordered ones or different from the information provided by ieffy.com 2. In the case that the delivered goods are broken, damaged, or contaminated 3. In the case that the goods are delivered later than the dates of delivery advertised 4. In the case that the User makes an order in the situation without presenting necessary items which should be done in advertisement by the Article 18 of the Door-to-Door Sales Law Article 15 (Protection of Personnel Information) (1) ieffy.com collect minimum information only necessary to proceed the purchase contract when ieffy.com collects User's information. The followings are obligatory and others are optional. 1. Name 2. Personal Identification Number (in case of member) 3. Address 4. Telephone Number 5. User's ID (in case of member) 6. User's Password (in case of member) 7. e-mail address (2) When ieffy.com collects personal information of a User, ieffy.com will surely ask confirmation from the User. (3) Personal information should not be provided to the 3rd person without the corresponding User's confirmation or not used for other purposes, and ieffy.com has all responsibilities for them. However, the following cases are exempted. 1. In the case that for delivery purpose the minimum information for a User (name, address, and telephone number) is transferred 2. In the case that information is provided in the form that the identification of a certain User is impossible for the purpose of statistics, academic research or a marketing research (4) In the case that ieffy.com needs a User's confirmation by Clause 2 and 3, ieffy.com must specify or notify in advance the items defined by the Article 16 Clause 3 of the Law relating Usage Promotion of Information Network such as the identity of personal information manager (position, name, telephone number, and other contact points), the purpose of collecting and using information, details of the 3rd person who is provided the User's information (name, the purpose of information provision, the contents of information provided), etc., and the User can withdraw the confirmation at any time. (5) A User can request at any time the perusal and error correction of his/her personal information ieffy.com has, and ieffy.com has the obligation to immediately take necessary actions for it. In the case that the User requests the correction of errors, ieffy.com may not use the personal information until errors are corrected. (6) ieffy.com limits the number of managers to minimum for protecting personal information, and has all responsibilities for User's damage by the loss, burglary, outflow, and modification of User's personal information including credit card number, account number, etc. (7) ieffy.com and the 3rd person who is provided personal information destroy the corresponding personal information after finishing the purpose of collection or provision of personal information. Article 16 (Obligation of Mall) (1) ieffy.com will not do any actions prohibited by the Law and this Agreement, or run counter to the public order and customs, and will do its best to steadily and securely provide commodities and services according the rules of this Agreement. (2) ieffy.com has to equip security systems for protecting User's personal information such that User can securely use Internet services. (3) ieffy.com has the obligation to compensate User for the loss of commodities or services by the improper marking or advertisement according to the Article 3 of the Fair Trade Act of Marking and Advertisement. (4) ieffy.com will not send e-mail for commercial advertisement that User does not want. Article 17 (Member's Obligation for ID and Password) (1) A member has the obligation for the management of ID and password except the case of the Article 15. (2) A member should not let 3rd person use his/her ID or password. (3) As soon as a member recognizes that his ID and password are stolen or used by the 3rd person, he/she has to notify the fact and follow ieffy.com's guideline if any. Article 18 (Obligation of User) (1) A User is prohibited doing the followings. 1. Registration by false statements at the time of application or modification 2. Modification of information posted on ieffy.com 3. Transmission or post of information (computer programs, etc.) except the ones that ieffy.com determines to post 4. Violation against intellectual property right such as copy rights of ieffy.com or other 3rd person 5. Act of damaging credits of or disturbing business of ieffy.com or 3rd person 6. Act of opening or posting on the public obscenity or assaulted message, picture, voice or information run counter to the public order and customs (2) Information described Phrase 1 to 6 in the above or the information that is considered to be improper but posted on the cyber mall or the linked page from the cyber mall can be deleted or the link can be disconnected by ieffy.com without the approval of the corresponding person. However, ieffy.com does not have an obligation to delete the information or disconnect the link. Article 19 (Relationship between ieffy.com mall and its link site) (1) In the case that the higher link and the lower link are connected by the kind of hyperlink (for example, the targets of hyperlink include words, graphs, moving pictures, etc.), the former is called a "connecting mall (web site)" and the latter is called a "connected mall (web site)". (2) In the case that the connecting mall specifies on its web site that it does not have any responsibilities for the trades between Users and the connected mall on goods and services the connected mall solely provides, the connecting mall has no responsibilities for the trades. Article 20 (Belongings of Copyright and its Limit of Usage) (1) The copyright of works done by ieffy.com and other intellectual properties are belonging to ieffy.com. (2) Users should not use the information achieved using ieffy.com for profit-making by copying, transmitting, publishing, distributing, broadcasting, or other ways or should not let 3rd person use without ieffy.com's approval. Article 21 (Settlement of Dispute) (1) ieffy.com opens and operates the organization for reflecting User's opinions or discontents and processing compensation for User's loss. (2) ieffy.com processes first of all User's discontents and opinions. However, if the processing is delayed for some reason, ieffy.com immediately notice its reason and processing time to User. (3) The settlement for the disputes between ieffy.com and User can follow the arbitration of the Dispute Arbitration Committee of Electronic Trade established by the Article 28 of the Law for Electronic Business Standards and the Article 15 of its Enforcement Ordinance. Article 22 (Jurisdiction and Legal Conformity) (1) The lawsuit against the dispute of electronic trade between ieffy.com and User is brought to the competent court by the Civil Proceedings Act. (2) Korean law is applied to the lawsuit against the dispute of electronic trade between ieffy.com and User.
